ELECTIONS AND RULES THEREOF
(a)
Only regular members who have paid all their dues/subscriptions to
the club at least seventy two hours in advance of the date slated
for publication draft electoral rolls and who have not been formally
barred from exercising voting rights by the Managing Committee on
grounds of indiscipline shall have right to vote in the election to
members and office bearers of the Managing Committee.
(b)However,
claim to inclusion in the voters’ list after the publication of
draft electoral rolls shall be entertained only if the same is
proved beyond any reasonable doubt with documentary evidence that
the concerned regular member’s name has been dropped inadvertently
or by error. No claim to inclusion the final electoral roll shall be
entertained on any ground other than the one mentioned above.
The
regular members of the Club shall have right to file objections to
inclusion of any other member in the draft electoral roll provided
such objection shall be filed in writing to the Secretary of the
Club within twenty four hours of the publication of draft electoral
rolls with documentary evidence showing why the impugned name should
not have been included in the draft rolls.
The
entire process of filling claims and objections and consideration of
the same by the Managing Committee shall be completed within two
days of the publication of draft electoral rolls and followed on the
third day by publication of the final electoral rolls , showing
therewith year wise commencement of membership provided the
seniority of a member shall be discounted in the event of any member
remaining off the official rolls of registered membership records
for more than a year.
The
entire process of publication of draft and final rolls shall be
completed before issuance of notification for election and the
decision of the Managing Committee in respect of inclusion or
exclusion of members in and from draft and final electoral rolls
shall be binding and final.
The
outgoing Managing Committee, at least a week before the expiry of
its normal or extended tenure , as the case may be shall issue
notification for election to the new Managing Committee specifying
dates for filing nomination, scrutiny and withdrawal thereof , time
and venue of the Biennial General Meeting as well as of the polling
so that the entire process including declaration of results is
completed within a period of fifteen days though there shall be
intervals of at least twenty four hours before scrutiny of
nomination papers, at least forty eight hours before withdrawal of
the same and not more than five days before actual polling.
The
issuance of notification for election shall be accompanied by
nomination of a three member panel comprising a senior person or a
registered advocate, reasonably experienced in conducting elections,
as Returning Officer and two senior associate members as Presiding
Officers who shall assist the Presiding Officer in smoothly running
the election. The Returning Officer shall be the highest appellate
authority and his decision on all matters pertaining to the election
shall be final and binding.
The
right to contest election to the posts of members and officer
bearers of the Managing Committee shall be restricted to only
regular member of the Club who have completed three uninterrupted to
years of membership without being subjected to expulsion the
Managing Committee on ground of indiscipline.
Any
member intending to contest election to members and Office Bearers
of the Managing Committee shall at the time of drawing nomination
paper make a deposit with the Managing Committee of a consolidated
amount of Rs. 50.00 out of which Rs. 10.00 and Rs. 25.00 shall go to
the account of the Club as the price of nomination paper and as
expenses incurred in conducting the election respectively. The
remaining Rs. 15.00 shall be refunded to the depositor after the
election provided he/she has secured at lest one more than 10% of
the total valid votes cast in the election. Any candidate failing to
secure at least one more than 10% of the valid votes shall not be
entitled to refund of the amount of Rs, 15.00 . The Managing
Committee shall, however, be competent to review and raised the
rates mentioned herein above as and when required.
No
candidate for the election shall file nomination for and contest
more than one post of members or/and officer bearer.
The
nomination paper of a candidate shall be separately proposed and
seconded by tow regular members of the Club. However, no regular
member shall propose of second more than one nomination paper.
The
Managing Committee, on demand, shall make available to candidates
voter list in lieu of a price fixed earlier to meet expenses for
printing or photo copying of the same.
None but
candidates for election themselves and office bearers of the
outgoing Managing Committee shall attend the process of scrutiny of
nomination papers, withdrawal of the same, counting of ballots and
declaration of results by the three members election panel.
